Service Description

West Virginia Pest Control provides professional pest management and extermination services to residential and commercial customers throughout the state of West Virginia. Our services include, but are not limited to, inspection and identification of pest infestations, treatment for common pests such as termites, ants, bed bugs, rodents, spiders, cockroaches, wasps, and other nuisance wildlife, implementation of integrated pest management strategies, preventative maintenance programs, and follow-up monitoring visits as specified in individual service agreements. All services are performed by licensed technicians in accordance with applicable state and federal regulations governing pesticide application and pest control operations. Service scope, frequency, and pricing are determined by written agreement or work order executed prior to commencement of services. We reserve the right to modify service methods, products, and scheduling based on site conditions, weather, regulatory changes, or other operational factors that may affect treatment efficacy or safety.

No Guarantee or Warranty

West Virginia Pest Control does not guarantee complete elimination of all pests from any treated property. Pest control results vary based on numerous factors beyond our reasonable control, including but not limited to structural conditions of the building, surrounding environment, weather patterns, re-infestation from adjacent properties, and customer compliance with preparation and post-treatment instructions. We do not warrant that our services will prevent future infestations or that treated areas will remain pest-free for any specific duration. Any recommendations regarding treatment timelines or expected outcomes represent professional estimates based on typical conditions, not guarantees. Our liability for any service performed is strictly limited to the terms set forth herein and in any applicable service agreement. Customers acknowledge that pest biology and behavior involve inherent uncertainties, and no pest control provider can assure absolute eradication or permanent prevention.

User Responsibilities

Customers must provide accurate information regarding pest activity, property conditions, and any prior treatments at the time of service request. Prior to scheduled service, customers are responsible for preparing the treatment area as instructed, which may include removing pets, covering food preparation surfaces, relocating sensitive items, and ensuring access to all relevant areas of the property. Customers must disclose the presence of children, elderly individuals, pregnant persons, or individuals with chemical sensitivities or respiratory conditions who may require special precautions. Customers agree to follow all post-treatment instructions provided by our technicians, including re-entry timelines, ventilation requirements, and cleaning restrictions. Failure to comply with preparation or post-treatment instructions may reduce treatment effectiveness and will not constitute grounds for service credit or refund. Customers must promptly report any adverse reactions, persistent pest activity, or concerns within the timeframe specified in their service agreement to allow for appropriate follow-up action.

Limitation of Liability

To the maximum extent permitted by applicable law, West Virginia Pest Control shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to property damage, personal injury, lost profits, business interruption, or emotional distress, regardless of whether such damages were foreseeable or whether we were advised of the possibility of such damages. Our total cumulative liability for any claim arising from services rendered shall not exceed the total amount actually paid by the customer for the specific service giving rise to the claim. We are not liable for damage to personal property, landscaping, or structures resulting from pre-existing conditions, customer failure to disclose relevant information, or acts of third parties. Customers assume responsibility for securing or removing valuable, fragile, or sensitive items prior to service. This limitation of liability applies regardless of the legal theory under which any claim is brought, including contract, tort, negligence, strict liability, or otherwise.

Intellectual Property

All content, materials, and intellectual property associated with West Virginia Pest Control, including but not limited to our business name, logos, service marks, trade dress, website content, photographs, technical methodologies, treatment protocols, and customer communications, are the exclusive property of West Virginia Pest Control and are protected by applicable trademark, copyright, and other intellectual property laws. Customers and website visitors are granted no license or right to use, reproduce, distribute, modify, or create derivative works from any of our intellectual property without prior written consent. Any feedback, suggestions, or testimonials provided to West Virginia Pest Control may be used for marketing and promotional purposes without compensation. Unauthorized use of our intellectual property may result in civil and criminal penalties under federal and state law.

Governing Law

These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law principles. Any legal action, proceeding, or dispute resolution involving West Virginia Pest Control shall be brought exclusively in the state or federal courts located within Kanawha County, West Virginia, and customers hereby consent to the personal jurisdiction and venue of such courts. Customers waive any objection to jurisdiction or venue on the grounds of forum non conveniens or any similar doctrine. The parties agree that the Uniform Commercial Code as adopted in West Virginia shall not apply to these terms or any service agreement except where expressly referenced. If any provision of these terms is found invalid or unenforceable under West Virginia law, the remaining provisions shall continue in full force and effect.

Changes to Terms

West Virginia Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason, including changes in applicable law, business practices, or service offerings. Material changes to these terms will be effective thirty days after posting the revised terms on our website or upon providing direct notice to customers with active service agreements, whichever occurs first. Continued use of our services following the effective date of any modifications constitutes acceptance of the revised terms. Customers are encouraged to review these terms periodically. If any modification is unacceptable, the customer's sole remedy is to discontinue use of our services and terminate any active service agreement in accordance with its terms. We are not obligated to provide individual notice of non-material changes.
